Hey, thanks for all the replies. The dispatcher "mistake" was that she gave it to a guy who was to come in early AM to do this run: she was not aware of it but the car she told the driver to use had been put into the shop the night before. So he showed up and had no car to use and no one to call for help. (I was out of the country).
We had no contract, just a reservation. The guy made no attempts to find flights on other airlines.

Most of the judgements in my state have been limited to the amount of the service of the provider.

I have been sued under a very similar circumstance. Get out the checkbook cause you will be paying. In my scenario, I driver (yes, I mean driver) did not show up for work. The dispatcher missed it. Neither work for me anymore. Family called after they were at the church for the wedding, having driven there in their own car. We immediately sent a car to the church. Bride & Groom came out, got in the car, cruised around and we dropped at the reception. I refunded all the money. I gave them a 2 hour gift certificate for service on a future date on us and a letter of apology. I figured I had gone above and beyond. I was made to pay partial fees for the videographer and photographer who had been present to capture the bride getting in the car to go to church. Various other "fees" were included and the judge concluded that I had added stress to an already stressful day and the moment in time could never be recaptured. The judgement against me was more than three times the cost of the ride!

If there is proof that a contract was entered into & the motor carrier's failure to honor the provisions of the contract results in a monetary loss, there is a good chance the injured party will prevail.

Yes, I have heard of cases that hit the courts & the injured party won.
