For those who have missed it, a proposed change in state law that would of allowed the Hillsborough County Public Transportation Commission to issue temporary public vehicle driver's licenses to limousine drivers from outside of Florida was shot down in December.

This proposed change in the law was directly contributed to myself making known that I would challenge in federal court, any move by the HCPTC allowing limousine companies or drivers into Tampa who have not met the mandated licensing by Tampa's regulatory law, ch2001-299 Laws of Florida. Under this law, simply taversing the roadways of Hillsborough County while engaged in passenger vehicle for hire business subjects the limousine operator to a variety of criminal penalties.

For past Super Bowls the HCPTC simply ignored its' mandate given by the Florida Legislator tossing the law aside and allowed untold amounts of limousine and taxicab companies and the drivers to engage in business without the licensure that Florida Statute demands and numerous arrests and defense of civil suits are based on. I plan on it not happening in 2009!

Obviously the NFL, the NFL's event management teams of Ridgeway International & Gameday Events plus Avis/Carey International are not too happy about this and may try to circumvent the provisions of law. I'm watching!

I will update the info as necessary.

See, some do understand "what the big picture is".

Awhile back I posted an incident I witnessed at Tampa International. An Orlando based van arrived at TIA to meet passengers "originally" scheduled to arrive in Orlando. A little storm named Charley decided to screw things up & flights were diverted. Well, this sharp looking van driver decked out in his Sunday best was informed to depart TIA or face criminal charges as mandated in the "LAW".

In the meantime, the coward of an executive director of this regulatory agency had his kneepads on with the rest of the Tampa Super Bowl Delegation giving the NFL BJ's to secure the 2009 Super Bowl.

Law? What Law?

This moron knows full well that NO limousine service can conduct busniess operations in Tampa without licensure as mandated in state law. But this kneepad wearing gutless wonder who had no problems tossing the small guys into jail & trumping up charges, decided on his lonesome that the law was not applicable to Carey International, its' affiliates & drivers as well as any other Tom, Dick & Mary who was willing to pay a Tampa limo company for a temporary permit under an imaginary clause in the law allowing subcontracting.

Now how are they going to enforce this LAW when they, themselves have massively violated it? I can picture the next operator in front of a Judge., "hey Judge, what the fark. The PTC has allowed thousands of unlicensed limos into Tampa over the previous years & here I am getting arrested just for picking up "my" customers for transport back to Sarasota".

Reason why they only went after changing the law for out-of-state drivers is because they can't seek other licensing changes without admitting they violated the law previously.

Some of us are smart enough to know that few if any will submitt themselves to the licensing ordeal imposed by, not the HCPTC, but, mandated in Florida law just to work the Super Bowl.

Knowing that this gutless industry would not band together & give Tampa the Big Fark You & refuse to help make the Super Bowl a success, I am doing it for them by insisting that the law be enforced.

Want to play? Pay or stay away!

Now the disgraced ex-Executive Director, Greg Cox, has been hired on by the Tampa Super Bowl Host Committee as some sort of transportation guru. And I know he will be reading this post.

Section 7 ( 5 ) Chapter 2001-299 Laws of Florida

( 5 ) Except for wrecker operators, certificate holders may contract with individual operators holding licensure as prescribed herein for the operation of its public vehicles, provided any such contractor is responsible for the operation and performance of any such subcontractor in accordance with this act and any rules adopted in accordance with this act.

This should answer any questions on the subject of if a licensee has the authority to subcontract out jobs to a non-licensed limo company or obtain permits for vehicles operated by non-licensed limo companies during the Super Bowl.

Under Florida law, VFH are integral to travel services. Because I am required to post a performance bond, part of the argument before the courts is that as I am held financially responsible for the execution of the movement, local governments cannot prohibit me from providing the prearranged travel provisions.

Most municipalities i.e., Orlando, recognize the Seller of Travel status & exempt them from local registration & bonding pursuant to the preemption clause contained in the Seller of Travel Act.

The only motor carriers that the Florida DOT is mandated with regulating just happens to be motor carriers providing passenger transportation in buses as defined under Florida statute. If the vehicle is designed to transport 15 or more (intrastate) including the driver then the motor carrier is required to register with the DOT & apply the numbers to their vehicles. Yes I am registered.

I don't care about working the Super Bowl. I care about intercounty motor carriers being able to enter Tampa 365 without subjecting themselves to the Draconian economic regulation, Taxicab protectionism BS that is now in place & supported by Tampa limo ops who are clueless to the operational needs of outlying counties serving their local communities.

These Maggots will throw a intercounty motor carrier in jail one day under the mandate given in this state law & in violation of the same law, allow a thousand in, not only from Florida but other states, the next just because its' the Super Bowl & these lawbreaking regulators asses will be handed to them by local businesses if they tried to enforce the law. The double standard ceases in 2009!

To make things simple, anyone wiith questions should click on the link I've provided for the law & read Section 7 ( 1 ) & ( 2 ), Section 8 ( 1 ), and Section 11 ( 1 ) & ( 2 ). If you can find a loophole, post it as it will be beneficial to all.

Not sure about the van count but with a guess, there are about 1,500 taxicabs, vans & limos licensed with Hillsborough. Of course, unless the whole west central coast of the state stops traveling during Super Bowl week, only a certain percentage will be dedicated to the SB.

The State itself has the equipment to support mthe SB. It's just going to be a matter of who will go through the mandated licensing BS to work a week in Tampa.

I guess the free market does not apply when you are protecting your 2009 superbowl market. I think all of your posturing is quite comical. In such a case I think with all of the demand why not have a few limos in from neighboring counties. It's not about the law you claim to be protecting . It's about protectionisim.

That's OK, what I'm doing is well beyond the scope even of much more so called experienced operators who lack much brain matter & common sense or, as the now disgraced former HCPTC executive directors' e-mails have proven, regulators.
