From the IRS: Taxicab Driver Example. Tom Spruce rents a cab from Taft Cab Co. for $150 per day. He pays the costs of maintaining and operating the cab. Tom Spruce keeps all fares he receives from customers. Although he receives the benefit of Taft's two-way radio communication equipment, dispatcher, and advertising, these items benefit both Taft and Tom Spruce. Tom Spruce is an independent contractor. To be A true Independent Contractor in the Limo industry, The company has to RENT you the Limo for a specific period of time for a specific amount of money and you KEEP ALL the money for the run. Example: You rent the Limo for $200.00 for 24 hours. You do three runs and collect $900.00 plus $300.00 in tips. You pay for the Gas, wash the car say maybe $75.00 out of pocket. You made $925.00 for the 24 hours, not the $150.00 or so the company so generously paid you. Now on the other hand, you pay $200.00 for the car and do one run for $150.00 plus $25.00 tip, you gas and wash the car for say $40.00 you lost $65.00 for the day. But that is waht the IC deal is all about, you run the risk of profit or loss. _________________ As a Chauffeur, I want to make sure that all Chauffeurs are treated fairly by their Employers. This is the IRS example of an acceptable Independent Contractor operation not mine. The Taxi Driver is taking runs dispatched from the Taxi Company as well as picking up hails. I know we do not pick up hails in the Limo business but under this arrangement, there is nothing stopping you from finding your own business where ever it is even if it is at a Competetors.

In your example where is this chauffeur getting his work from? on his own, and all I have to do is rent him a vehicle.
