Russell Figaredo www.abcnyclimo.com For my Laguardia Limousine service, I just went to other sites and found a disclaimer of some sort. I cut and pasted and added what I needed. |

Well, we dont deal with much of corporate world. I know that those people need things right away and dont have time to go on the internet and fill out any contracts. Well, we used to take reservations over the phone back in the days but NO MORE. After so many losses - all the reservations are done electronically and since most of our bookings are bookings ahead of time - no customers have problems filling out online contract. Wheather they read it or not in full - its out of my hands but sometimes we get a feeling that people dont read it because they are surprised that eg. there is waiting time, overtime, payment up front, etc. There is many people that sign the contract without reading but hey - its their loss. Well, everybody books cars in different way at different prices. That is how my boss choses to run his business and it works for him very good. With this contract - we win 100% disputes. There is no surprises after the service because everything was explained. We used to do booking over the phone and either at the time of the service or after people call and ask "How come you didnt tell me that when I booked a car" - well with this setup there is no more questions of that nature and there is no surprising phone calls. We used to get so many calls like that - my boss just said - enough is enough. Agree to all the terms and conditions or take a flight. You mentioned "your well educated clients" - you are lucky you have a lot of those. I find about 50% of our clients are well educated - rest of them are just dumb or uninformed. That is why the contract brings them up to speed with things. |

I am absolutely speechless. I don't have anything that elablorate and my losses are still lower than yours. I think most of my well educated, well heeled clients would tell me to take a flying.........ah, you know.....if I took up that much of their time to book a ride from their corporate office to the airport.
I guess it is all about who you are serving as to what you need to spell out. Wow! |

Ohh yes, pretty much. There is no reservation without agreeing to all of it. Guess what? That keeps our losses down to 0.03%. Here is the full abstract: Contract |

Too bad it can't be like a Taxi ride. You get in, you takes your ride, you pay the Driver what is on the meter, (if you don't, the Diver calls a Cop and you go to Jail) you get out. Ride is done and on to the next Fare.

OMG! That's only part???? So the client needs to spend an hour reading the contract before they get in the car???
So that was just a "start"???? I can see it now...."all transactions must be done in U.S. Currency, credit card transactiosn can only be signed in blue or black ink, shoes must be wiped at least three times before entering the limousine, if you unfold a napkin a .16 surcharge is applied, if lipstick is left on any glassware, a lipstick removal charge will be assessed. Any glaring looks at your chauffeur is grounds for termination. A video camera is in use and you must smile at all times. Your likeness and image may be used in an upcoming reality TV show if we can find a producer" blah, blah, blah....... It's really a bit much to ask your client to read and signed something so detailed. It's a limo ride not a freakin' home mortgage. I would highly suggest you summarize it rather than itemize it. |

Seriously Green.......you couldn't just summarize?????
By the way, we have a corporate attorney who is the one who wrote our contract. As a side note, our attorney likes riding in a limousine so it is all trade. You can never have too much trade with an attorney. Problem collecting on an account? Have the attorney send a letter. The bills get paid pretty quick. Need a legal opinion? Their a phone call away. I like to keep him owing me. |

While this is a good idea for a guide as to what to state, remember before you use anything for actual business use is looked over by a lawyer or someone who knows what would be binding in your area. Two main reasons: 1. Many smaller businesses will put together something that they use, but may not be legally binding to hold up in court in case you auto charge their credit card. 2. Even if something is binding in one state, the rules or terms used may be different in your state. So if you do this, look more at ones in your state, (and also Ohio since you service that as well) and also try to look for larger (corporate status, not vehicle count) limo companies. And please, this last part is not meant to be mean, but after seeing your ads you are running online, make sure you get someone to grammar/spell check your ads and contracts. -Greg |

Jim, This is a great post. It will be a value to many of the prospective operators who lurk on these boards. It's a shame the forum software doesn't allow us to "sticky" these type of messages. Dave |

I decided to post our contract here so that others may copy it or perhaps improve it:

Lessee is responsible for any damage to the vehicle, loss or breakage of contents (i.e. glasses, decanters etc.). An additional fee of $150 will be assessed for excessive cleanup. A $300 charge shall be applied if a carpet shampoo is required. Downtime for cleaning and/or addtional repairs shall be at an addtional cost to you. We are not responsible for lost items or items left in our vehicle. Your trip may be terminated at anytime without a refund for misconduct, failing to comply with our policies or your chauffeur. No one under the age of 21 is permitted to consume or handle alcohol in the vehicle. There are no refunds unles otherwise noted on this contract. Any additional charges such as tolls, parking, damage or other charges will be immediately billed the credit card presented or to your corporate account. Your signature acknowledges and consents to all terms of this agreement. |
